In for a penny, In for a Pound

How does a claimant get a sensible answer from ACC.

ACC's legal services have stated that "if the claimant is correct it will cost the corporation a lot of money"

I have proved at review that I am illegally on ACC. The reviewer stated "you are illegally on ACC. But that is not my decision to make!"

No? Is that because the reviewer stated at the start of the review that it not their Jurisdiction".

No? Is it because ACC's legal services have told ACC that they must not make a decision regarding my entitlements!

ACC are most adamant that their decisions are not decisions!

DRSL is happy to comply! A Judge has allowed that Administrative decisions are not able to be reviewed.

3 Senior ACC managers have stated that they will use ACC's discretion and continue to pay me benefits and entitlements that I am not entitled to.

So the question is...

What discretion does ACC have to pay entitlements a claimant is not entitled too?

Well Phil Riley manager of ACC's recover independence unit states in an interview with Radio New Zealand that ACC will pay claimants

no more and no less than what they are entitled too.

David Balham media spokesperson for ACC stated that it would depend upon the circumstances. He also promised to reply to my written question. Yeah right!

Pansy Wong Associate Minister for ACC has not bothered to reply to my written question.

Dave Rollo Operations Analyst states

ACC will use its discretion and continue to pay

Randle Southee Service Delivery Manager National Serious Injury Service simply finds ACC's bullshit to confusing and refuses to discuss the matter.
