And ACC couldn't give a monkeys!
You'd have thought that somewhere in ACC alarm bells would have rung!
But no ACC refuses to make a decision.

"WINZ are stating that this women is not able to receive WINZ assistance for 5 years because she got 35K from ACC...
An income of $7000 per annum... Well below the minimum wage! Well below the poverty line..."http://www.accfocus.org/news/news/woman-denied-benefits-after-acc-payment.html
To be correct Muppet WINZ are stating that this women is not able to receive WINZ assistance for 5 years because she got 35K Tax Paid! from ACC...
An income of $7000 per annum Tax Paid... Well below the minimum wage! Well below the poverty line... What is ACC trying to hide?
Has ACC stated they paid Tax on this amount? Is there a tax record?
There should be!

How does a claimant get a sensible answer from ACC.
ACC's legal services have stated that "if the claimant is correct it will cost the corporation a lot of money"
I have proved at review that I am illegally on ACC. The reviewer stated "you are illegally on ACC. But that is not my decision to make!"
No? Is that because the reviewer stated at the start of the review that it not their Jurisdiction".
No? Is it because ACC's legal services have told ACC that they must not make a decision regarding my entitlements!
ACC are most adamant that their decisions are not decisions!

Just a small paragraph to signal then end of a 16 year battle for justice.
"Keith and Margaret Berryman have "reluctantly" accepted a "take it or leave it" $150,000 settlement from the Government as compensation for the collapse of a bridge leading to their King Country farm in 1994." New Zealand Herald January 3'rd 2010
I admire the Berrymans for their stand to obtain Justice.

Last night TV3 issued a statement of correction about a Nightline article on ACC it ran on the 17'th April 2009.
"Complaint under section 8(1B)(b)(i) of the Broadcasting Act 1989
3 News and Nightline – alleged that ACC had not fulfilled its legal obligation to tell its clients about an Independent Earner Tax Credit – allegedly unbalanced and inaccurate
Findings
Standard 4 (balance) – complainant concerned that it was not given an opportunity to respond to one statement in the item – that issue was not a controversial issue of public importance – not upheld
Standard 5 (accuracy) – item was inaccurate in stating that ACC had a legal obligation to inform its clients of the credit – one aspect upheld" BSA Decision No: 2009-074

Well I kinda resented the fact that again I missed out on the government's Kiwisaver tax credit because I was on ERC... or the benfits of the new scheme...
Thanks to Pete's comment for this info.
Woohoo a bit of checking with the IRD and Kiwisaver confirmed everything.

I've been unpacking slowly over the past couple of weeks.
Woe, today my ACC files surfaced.
I can't say Ive missed having them around either... But (and isnt there always a But) I guess tomorrow will be time to start drafting a few more letters.
However today was great, and I enjoyed a few brief moments with a cold one on the back deck.

As part of the sites restructuring (Knowledgebase/Judgements) I've been noticing a few documented cases of ACC staff stroking the facts to suit the corporation.
Feel free to add your own documented facts.. or send copies of the relevant "manipulations" to the admins.
We will remove any personal details before publishing.

Teen driver who smashed into tree had no licence
Well apart from the usual concerns about 13- 15 yr olds out after midnight committing crime instead of being safely at home; amazement that the kids parents were unaware of their whereabouts and activities.
The cost to the motoring levy payer of this "teenage escapade" must already be fairly substantial.
Should the driver be convicted of driving a stolen vehicle will ACC as is required by law stop paying for his rehabilitation and treatment?
I hope so!
What about the other young kids? What happens if they are charged and convicted of getting into a stolen vehicle? Will ACC "benefits" ie treatment, rehabilitation cease as well?
I hope so!
Then I guess that treatment and rehab costs will then fall on all the taxpayers evenly in that the local DHB & the Education department will be responsible for ongoing rehab costs and the provision of special equipment if required.
Sux eh!
