"As has been recently pointed out to me; in this financial climate ACC needs to spend wisely to ensure the viability of the scheme both now and into the future in order for ACC to meet its obligations to levy payers.
As a levy payer I wholeheartedly support ACC’s “Driving value for Money” approach so I feel obliged to draw your attention to the following matter.
Overpayment of entitlement.
Three senior ACC staff have identified that I am in receipt in of an entitlement that I am not entitled to.
21/11/06 Chris Rollo operations analyst identified that a staff loan was not an allowance and therefore of no benefit.
3/10/08 Justin Raffan concurred.
3/10/08 Peter Flynn Technical Claims Manager Wanganui stated that a “staff loan was not a staff loan but an interest reduction agreement” and therefore not a benefit to the claimant."

Well I have hassled ACC complaints about this matter twice now.. Even ACC complaints can't be bothered getting back to me!
Is it as "let slip" by one of the complaints staff; ACC does not want to discuss this matter ?
I am feeling extremely vulnerable with a possible huge bill from ACC for overpayment of entitlements!
Its not as I have asked any difficult question's is it?

Does ACC have the discretion to continue to pay an entitlement to a claimant when it has been identified that the entitlement is invalid?

Please provide a copy of ACC’s policy on discretion and the payment of entitlements to claimants where it has been identified that the entitlement is not permitted.
- Please advise the gross amount of overpayment.
- Please advise whether I will be required to repay the overpayment.
- Please provide an updated ERC calculation to correctly reflect the above facts.
I am after all just asking for clarification of the bullshit ACC considers to be fact on my claim!
As for "Driving value for money" it would save ACC heaps by simply answering my queries!
Not that I expect them to state "no decision was made as per ACC policy"! Policy which demonstrably overrides the claimants code of rights.
Otherwise I will have to go through the whole costly process of a several further complaints and sundry reviews via the code of claimants rights.. Not that I expect to get anything but further documented proof that ACC policies are deliberately written to circumvent ACC legislation and deny claimants a "fair" shake.
Ah well a paper trail will be worth something one day!

I may be wrong!
Having found that ACC Staff have stolen or replaced an identity and getting more and more concerned that ACC may one day demand repayment of all payments made to the incorrect identity.
Is: Write to the Privacy Commissioner explain that ACC has altered your identity and Injury and accident details and destroyed your real identity.
Ask (1) If you are committing fraud by, (considering the EVIDENCE you hold, being aware that ACC have altered your identity and that there is absolutely no evidence as to why the new claim used in your name exists or that any such claim was ever lodged on your behalf). accepting ACC continued use of the incorrect file.
Also do a complete check of the medical records to make sure no such claim has even been lodged on your behalf but don't let the result out.
(2) You are concerned that ACC may at some stage demand repayments made under the incorrect file.
Do not supply the Privacy Commissioner with any information say that you are not a Beurocrat or a Doctor and it is up to ACC to keep files in order.
Keep in mind the onus is on ACC to do their job according to the Law of the Land, let them do all the work according to the Law do not do their job for them in any way!
Without getting too long winded the ACC will reply to the Privacy Commissioner with selected material from the files and an opinion that the file used in your name is definitely your file and simply two duplicate files for the same diagnosis have been merged.
MY small note here that one file was for a person born in 1942 and that the diagnosis is not the same and that there does appear to be some file material altered to make the two files seem duplicate at a different date (Or possibly someone created a second file in my name and milked it to their advantage then destroyed the "wrong" file at a later date is a conspiracy theory much as being able to create duplicate boarding passes for air Lines has just been noticed.
Basically ACC will supply OPINIONS with no substantive EVIDENCE that the new claim and identity created for you on a particular date for an accident at a time when your ACC claim had ended and not yet been reinstated for an accident in a place and at a time when it could not possibly have occurred and for a diagnosis which would probably never have been covered by ACC and with no EVIDENCE outside of ACC of such a claim ever being lodged is your claim and identity.
Do not take the privacy matter any further, just leave it according to ACC's opinions.
This seemingly is the best ADVANTAGE for you as it absolves you of any danger of ever having to pay back monies paid under the incorrect claim identity and details.
Also in any actions at all ACC's first problem would be to prove or provide EVIDENCE stronger than that which you hold that the person or identity held by them is you.
Such may not be of advantage Money wise but long term it certainly helps keep the wolves and discrimination at bay.
I would even suggest that at any Assessment, never supply any information you may hold and always insist that you are fine. Let the assessment report rest on the information supplied entirely by ACC such has interesting outcomes

Additional I now have another formal complaint lodged... I am entitled under the claimants code of rights to effective communication... Ignoring my complaint is not effective communication.
I require a written reply to my original complaint. Simple really... There is no overpayment because there is no decision!
As noted by the ACC Manager "in accordance with ACC Policy" ACC will not make a decision even though three Senior Managers stae I am not entitled to benefits...

Imagine ACC's delight at the thought of euthanasia becoming Legal and condoning arranging meetings and assessments in toxin filled rooms or condoning suggesting to GP's that Accident injured people be prescribed appropriate life ending treatment or driving people to suicide being condoned as appropriate shortening of perceived suffering or illness belief
we must be careful not to throw the Baby out with the Bath Water.
With legalized euthanasia imagine the possibilities, everyone "disabled" or injured or having illness beliefs could be euthanised, gradually as happens the barriers would widen and lower until almost any reason could be used to put you down, all those over 35 could be put out of thier misery, all those unemployed, all those daring to raise issues.then to save even more Health funding anybody seemingly taking any inappropriate actions could be imprisoned while awaiting trial ,hang on we already do that.
Just imagine all ACC would need to do would be to create a new claim and file in your name (Oh they already do that) Declare you mentally injured (Damn they do that)destroy any information which shows other wise (Done that) then the way to euthanasia you only needs Legalising and voila no more serious accident claims leading to long term illness beliefs.
Strange how most people you meet now say everything any Government touches instantly turns to shit.
Live Long and prosper stay away from ACC and the so called Health System.

Debbie Watts ACC Team leader ordered a physc profile... "his belief is ACC incorrectly assessed his weekly compensation in the 1980's and he has not been reassured by this being addressed and confirmed as correct.."
Did ACC get "value for money" from this profiling exercise? supplying only a few of the medical reports to the profiler is IMHO most definitely not "value for money".
Sadly Peter Flynn Technical Claims manager of Wanganui did recognise my concerns. But his report has been "buried" in bullshit.


Still no reply from ACC complaints.
Expected of course.
After all ACC complaints are not going to tell me that there is no overpayment because ACC didn't make a decision are they!
ACC complaints are not going to state that ACC policy is not to make a decision.
ACC complaints cannot provide a copy of the policy Chris Rollo, Justin Raffen and Peter Flynn followed because there is no such policy!
And of course ACC complaints will not tell me that those three letters on file are all BS. Well they can't can they?
No ACC complaints are going to continue to ignore me...
