The introduction of ACC's EOS system has seen hundreds of thousands claimants files destroyed.
"[56] The other aspect of this is that it is the Corporation who are responsible for the loss of documentation through their choice to destroy the file.
[57] A fundamental maxim of equity is that "one who comes into equity must come with clean hands" or that equity will not permit a party to profit by his own wrong.
[58] It should not be that the Corporation who wrongfully suspended the appellant's entitlements should benefit from the loss of documentation which had been in their possession." Miller vs ACC"
It is now readily apparent that ACC have deliberately destroyed claimants records in a manner calculated to reduce the actuarial liability of the corporation.
Claimants are finding that ACC has no record of their claims and are now being denied their legitimate rights by ACC who are declining their applications for assistance on the basis that there is no record of such a claim.
Very strange considering that ACC's own financial records held for seven years show that treatments and assessments have been performed on valid claims yet ACC are now denying the same because they hold no records!
Claimants attempting to obtain a complete copy of their files are being denied their legitimate rights and supplied only partial copies or worse finding that ACC's records relating to their claims have been destroyed
Requests made under the Official Information Acts have revealed that ACC's EOS system has no audit trail relating to file access and that ACC can not guarantee the completeness nor accuracy of any single claim record that they do hold.
This is blatant fraud! Condoned and managed by the Board of ACC, The Chief Executive Officer Dr Jan White and the Minister of ACC the dishonourable Dr Nick Smith.

Been watching stuff on the forum over the last little while.
Note 1 when ACC are asked to search and provide copies of all records check to make sure they have not, as I noticed used incorrect spelling of your name when searching records, at guess this incorrect spelling may have been done to avoid "finding" a lot of "destroyed" information (As a technical claims manager instructed a Case Manager ACC may no longer hold such information and it is up to the client to prove they ever did... bullshit)
Also on keeping records of everything, I suggest keeping no records at all especailly as it seems Legal opinion is it seems that what ever the claim number and details ACC use is of no importance at all.Keeping records will result, I bet, in you one day going through those records and becoming fearfully aware that it is not good for your health to hold such a complete picture of exactly what has gone on so neatly set out.
Obviously ACC generates, or has generated files with the expectations that the file would soon be invalid and destroyed or that only they can select which parts of the records they want to show at any given time.
Unfortunately when things go so wrong one ends up with an almost complete image of exactly what happened and rather than risk more attacks one shreds and burns such instantly and vows never to keep records of anything ever again!
Destroy everything, keep nothing, and hope that one day your claim will simply end and you will never have ACC in your lives ever again.
Too late for me but NEVER allow any ACC claim to be lodged on your behalf if you do not want to be totally destroyed.
far better to become a poor starving artist than risk subjecting oneself to ACC's "future intentions"

Hi , my file was destroyed by ACC at some time in the 90's All my med reports had gone with it inc one with 20% funct imp. for lump sum. I reagrivated my injury in 2002, it was asigned as 'new injury'. I was sent for assessment and lo and behold, due to "no info on earlier injury provided at all" i found myself with a 10% funct imp rating. I did get a copy, at great personal effort, of the original report but this was 'lost' each time i re presented it to ACC. (Three times)

And with all the talk of privatisation of the Workers account! Inarguably fraud! Hopefully perspective purchasers will discover this problem when they carry out due diligence!
